民法总则是制定民法典的首要步骤,是统领整个民法典并适用于民商法不同部分的基础部分。为了保障民法总则的制定更加规范,立法人员应该以现有的民法通则为基础,进行合理的继承和适当的创新,把握好法律制定的原则,以法律关系为基础进行体系的建立,使民法总则的制定更加科学合理,实现其作为私法基本法的价值。
