人事保证,又称职务保证、雇佣保证,是以被保证人有损害用人单位合法权益从而产生合法债务为担保对象的、对将来债务之保证,是一种典型的信用保证,对现代社会的信用机制的构建能够起到一定的积极作用。我国理论界对人事保证制度的认识还存有较大分歧,在立法上对人事保证制度的规定尚未明确,在现实生活中因为人事保证而提起的诉讼又不断出现,各地法院因缺乏法律依据导致判决结果差异较大。本文对我国的人事保证制度进行全面检讨,提出了相应的立法建议。
Personnel guarantee, also known as job security and employment guarantee, is a guarantee of future debt guaranteed by the guarantor who has the legitimate rights and interests of the employer to produce legitimate debt. It is a typical credit guarantee and a credit system for modern society The construction can play a positive role. China’s theoretical circles have a lot of differences on the understanding of the personnel guarantee system. The provisions of the personnel guarantee system in the legislation are not yet clear. In real life, the lawsuits filed because of the personnel guarantee are constantly appearing. Due to the lack of legal basis Judgments vary widely. This article conducts a comprehensive review of China’s personnel guarantee system and puts forward corresponding legislative proposals.
