运行良好的技术标准体系有助于促进市场竞争和技术创新,而技术标准体系出现问题则会形成市场垄断,抑制创新。目前,技术标准已经出现专利化的趋势。在标准化组织的专利政策中,最基础的内容就是关于专利信息披露的规定,专利信息披露制度是专家评估制度和专利许可制度建立的前提。为此,本文主要从专利信息披露的内涵与外延入手,梳理专利信息披露的流程与主要环节,在对一些标准化组织的专利信息披露制度进行对比的基础上,总结出目前专利信息披露制度中的要点和存在的法律漏洞,并就完善标准化组织的专利披露制度提出自己的意见与建议。
A well-functioning technical standard system helps to promote market competition and technological innovation, while problems in the technical standard system will create a market monopoly and inhibit innovation. At present, the patent standardization trend has emerged. In the standardization organization’s patent policy, the most basic content is about the disclosure of patent information, patent disclosure system is the premise of expert evaluation system and patent licensing system. Therefore, based on the connotation and extension of patent information disclosure, this paper combs the flow and main steps of disclosure of patent information. On the basis of comparing the patent information disclosure systems of some standardization organizations, this paper concludes that the current patent information disclosure system Points and existing legal loopholes, and to improve the standardization organization’s patent disclosure system put forward their own opinions and suggestions.
