业主团体的法律地位及其在诉讼中的主体资格一直是业界争论不休的话题。如果从实体法和诉讼法的角度加以分析,业主团体具有真实的团体人格,作为业主团体代表与执行机构的业主委员会具有完全的当事人能力。业主团体这一地位的确立,可以更好地解决业主团体在物业自治管理理论与实践中遇到的相关问题。
Ownership of the legal status of the body and the main qualifications in the litigation has been a topic of endless debate in the industry. If analyzed from the perspective of substantive law and procedural law, the owners’ group has a true group personality and is fully capable as a client’s representative of the owner’s group and the implementing agency. The establishment of the owner group can better solve the problems encountered by the owners in the theory and practice of property self-management.
