西方学者多用“国际经济法”指代跨国经济领域的公法性规范。从研究方法看,实证主义和伦理指向是西方国际经济法研究的两个最主要的进路。西方国际经济法研究的经验是关注经济全球化并进行深刻而周密的论证,理论结合实践,进行跨学科研究。本文力图评介晚近西方国际经济法研究的主要动向,初步提出中国学界可以借鉴的方法与经验。
Western scholars use more “international economic law ” refers to the public legal norms in the field of transnational economy. From the perspective of research method, positivism and ethical orientation are the two most important approaches in the study of western international economic law. Western international economic law research experience is concerned about economic globalization and carry out profound and careful argument, the theory of practice, interdisciplinary research. This article attempts to comment on the recent developments in the study of international economic law in the West and preliminarily put forward the methods and experiences that Chinese academics can learn from.
