《河南省水文条例》(以下简称《条例》)在大量调查研究的基础上,吸收兄弟省市有关水文法规、规章的基础上,本着结合河南水文工作实际,有所创新,适度超前的原则制定,集中反映了各行业、各部门的智慧和建议,体现了与时俱进、开拓创新的时代精神。《条例》在7个方面有所创新和突破:一是《条例》确立了水文工作的双重管理体制。水文工作具有很强的公益性、地域性,其工作成果不仅为当地经济社会发展、基础设施规划、设计和建设提供重要的基础数据,同时为当地开展防汛抗旱、水资源管理、水环境保护等提供重要的决策依据。各级人民政府及水行政主管部门应当加强对水文工作的领导。《条例》第三条第二款规定“省辖市行政区域内的水文工
