住房和城乡建设部决定将《房屋建筑和市政基础设施工程施工分包管理办法》(建设部令第124号)进行修订。其中,将第十八条修改为:“违反本办法规定,转包、违法分包或者允许他人以本企业名义承揽工程的,以及接受转包和用他人名义承揽工程的,按《中华人民共和国建筑法》、《中华人民共和国招标投标法》和《建设工程质量管理条例》的规定予以处罚。具体办法由国务院住房城乡建设主管部门依据有关法律法规
