高房价问题一直以来被人们所关注,一方面由于我国土地制度存在制度缺陷外,另一方面也和房地产开发公司资金紧张有关。房地产企业由于对资金需求相对较高,因此如何设计有效地融资方式以解决房地产企业的融资难题,是其重中之重。本文通过对《公司法》具体条文进行分析,意在说明《公司法》的灵活性和其体现的个体主义立法思维,并说明个体主义立法思维可以有效解决融资难题。
The issue of high housing prices has always been the concern of people, on the one hand due to the existence of institutional defects in China’s land system, on the other hand, and real estate development company funds are related. Due to the relatively high demand for funds, real estate enterprises should focus on how to design effective financing methods to solve the financing problems of real estate enterprises. By analyzing the specific provisions of the “Company Law”, this article intends to illustrate the flexibility of the “Company Law” and the individualistic legislative thinking it embodies. It also shows that the individualist legislative thinking can effectively solve the financing problem.
