问题甲与乙为邻居,甲在乙房屋的前、后各建有房屋,乙处于甲所有的房屋或使用的土地包围之中,在甲所有的建筑物范围内有历史形成的必经通道。两者均在原房管部门进行了登记,各自持有产权证书,其土地范围、房屋产权清晰无争议,但乙不通过甲土地及房屋就不能通行。现在甲和乙要求分别办理不动产权利登记,在受理过程中,存在下列疑难问题:1、登记机构如何登记,才能保障乙的合法权利?2、如果乙没有申请不动产权利登记(如地役权登记),登记机构如何处理?
Problem A and B are neighbors. A houses are built in front of and behind B house. B is surrounded by all the houses or land used in B and there is a historic passage in the building of all buildings. Both were registered in the original housekeeping department, each holding a title certificate. The scope of the land and the property rights of the house were clear and uncontroversial. However, B could not pass without access to the land and the house. Now A and B require separate registration of real estate rights. In the process of acceptance, the following difficult problems exist: 1. How can the registration authority register the legal rights of B? 2. If B fails to apply for registration of real property rights ), Registration agencies how to deal with?
