一、工商行政管理部门建立工商企业信用档案的必要性和可行性 我国从计划经济步人市场经济以后。市场上的经济交易就已经烙上了信用危机的痕迹。最典型的是当时一些沿海地区走私贩私活动猖撅,制售假冒产品登峰造极,“逃债”、“坏帐”、“合同欺诈”等新名词纷纷出现。市场上出现的信用危机严重危及到了我国正常的经济发展秩序和对外经济交往活动,给我国的经济、社会带来了巨大的直接和间接损失。据有关方面估算,近年来,我国年平均假冒伪劣产品的产值超过1300亿人民币,国家每年因此损失税收250亿人民币。这不单单是假冒伪劣造成的损失,还有合同欺诈、虚假广告等等,每年都会给国家和市场主体造成巨大的损害。 工商行政管理部门作为国家行政机关,其职能就是规范和维护市场经济秩序,而要实现这一职能,首先必须建立和完善企业信用管理制度。其中,工商企业信用档案的构建,正是企业信用管理制度的核心内容之一。其次,工商行政管理机关作为政府主管经济行政执法的综合部门,也急需通过对企业信用档案的构建来提高自身的工作效率,提升管理的整体水平。其主要的职能优势在于:

As a national administrative organ, the administrative department of industry and commerce has the function of regulating and safeguarding the market economic order. To achieve this function, we must first establish and perfect the credit management system of the enterprise. Among them, the construction of commercial credit files is precisely one of the core contents of the enterprise credit management system. Second, as an integrated department in charge of economic law enforcement by the government, the administration for industry and commerce also urgently needs to improve its own work efficiency and improve the overall management level through the establishment of corporate credit files.
