目前在我国各地都存在偷逃公路通行费的行为,并且已经成为一个严重的社会问题。1997年全国人大常委会通过了《中国人民共和国公路法》,并经过了1999年、2004年两次修改,但是对如何处理该类行为规定尚不明确,不利于实际操作。政府应当重视对偷逃公路通行费违法犯罪行为的处罚,制定具体的法律规范,明确相关的法律责任,严惩不法行为。基于对现行立法的考察,我们尝试从中找出存在的问题并提出若干建议。
There have been evasions of highway tolls in various parts of the country and it has become a serious social problem. In 1997, the NPC Standing Committee passed the Highway Law of the People’s Republic of China and passed two amendments in 1999 and 2004. However, it is unclear how to deal with such acts and is not conducive to practical operation. The government should attach importance to the punishment of the crime of escaping highway tolls, formulate specific legal norms, clarify the relevant legal responsibilities and severely punish the wrongful acts. Based on the investigation of the current legislation, we try to find out the existing problems and make some suggestions.
