《华盛顿公约》和《仲裁(附加便利)规则》都规定,如当事方没有相反约定,仲裁庭有分配仲裁开支和其他相关费用的自由裁量权。在实践中,仲裁庭往往会根据对当事方申请或辩护的成功比例、有关法律问题是否具有新颖性、当事双方在仲裁程序中是否有效率地合作、偏向于申请方的“正义和公平”等多个因素的考虑来分配与仲裁程序有关的费用。以此为基础,我国在相关的国内立法、双边投资保护条约中以及日后参加“中心”程序时应该采取相应的应对策略。
