我国目前的不动产登记机关呈现多部门登记、分级登记的现象,登记机关的分散既不利于当事人进行登记,也利于当事人查阅,同时还不利于交易安全的保护。借鉴各地区关于不动产统一登记机关的立法例,我们可以通过立法确立由县级人民法院作为不动产的统一登记机关。在确立法院为不动产的统一登记机关后,对不动产的登记进行实质审查,并建立起相关的国家赔偿制度。
At present, the real estate registration authority in our country has the phenomenon of multi-departmental registration and hierarchical registration. The decentralization of the registration authority is not conducive to the parties to register as well as to the parties concerned, and is not conducive to the protection of transaction security. Drawing on the legislation in various regions concerning the unified registration authority for real estate, we can legislate to establish a unified registration authority as a real estate by a people’s court at a county level. After establishing the court as a unified registration authority for real estate, substantive examination of the real estate registration and the establishment of the relevant state compensation system.
