交通肇事逃逸致人死亡一直是我国刑法学界争论的问题,对于该行为的主观上如何定性,以致延伸到如何定罪,都是值得讨论的问题。本文先是对逃逸致人死亡的概念进行分析,其后对于其主观罪过进行讨论,最后提出如何定罪。
Causing traffic death to cause fatal death has always been a controversial issue in the field of criminal law in our country. It is worth discussing how to define the subjective behavior of the act so as to extend it to how to condemn it. This article first analyzes the concept of escape causing death, then discusses its subjective sin and finally puts forward how to condemn it.
