国际经济法是第二次世界大战后发展建立起来的一门新兴学科,它研究和调整的是国际经济关系中的重要而突出的法律关系和法律问题。由于国际经济关系中的法律问题纷繁复杂,涉及面极其广泛,国际经济法作为一门法律学科,它尚处于幼稚或创建阶段;中国在这方面的研究尚属起步阶段。但是,国际经济法同其他法律部门一样,它的产生和发展有其深刻的经济和社会根源;它是国际经济交流合作与国际经济秩序发展的必然要求。尽管各国学者对国际经济法是否已成为一门独立学科及该学科的体系和范围认识尚不一致,但中国对其的研究与发展方兴未艾。
International economic law is a new discipline established after the development of the Second World War. It studies and adjusts important and prominent legal relations and legal issues in the international economic relations. Due to the complicated legal issues in international economic relations and the extremely wide range of issues involved, international economic law, as a legal discipline, is still in its infancy or creation stage. China’s research in this area is still in its infancy. However, like other legal departments, international economic law has its profound economic and social roots in its emergence and development. It is an inevitable requirement for the development of international economic exchanges and cooperation and the development of the international economic order. Although scholars in various countries have not yet reached consensus on whether international economic law has become an independent discipline and the system and scope of the discipline, its research and development are in the ascendant.
