新闻媒体与司法机关作为理性人均必然谋求自身利益的最大化,即追求最大限度的新闻自由与最大限度的司法独立。根据博弈论相关理论,当二者分别进行理性选择并达成纳什均衡时,其既未实现整体效能的最大化,也未实现各自利益的真正最大化。因此,应当建立相应制度,通过明确权利界限,加大责任追究力度等方式,充分实现新闻自由与司法公正,以有效实现社会的民主与法治。
As a rational per capita, the news media and the judiciary will surely seek the maximization of their own interests, that is, the pursuit of maximum freedom of the press and the maximum judicial independence. According to the theory of game theory, when they make rational choices respectively and reach Nash equilibrium, they neither achieve the maximization of overall efficiency nor realize the real maximization of their respective interests. Therefore, corresponding systems should be established to fully realize the freedom of the press and the judicial imparties so as to effectively realize social democracy and the rule of law by clarifying the boundaries of rights and increasing the accountability of liabilities.
