基本案情谢某,中共党员,某市某镇A村党支部书记。2007年2月,谢某找到担任该市某街道办事处主任的表哥王某,提出由王某所在的街道捐资10万元,用于维修谢某和王某的家乡某镇B村公路。王某表示同意,同时提出这笔钱由街道捐赠给镇政府,再由镇政府安排用于维修公路。10万元捐款转到镇政府财务账上后,镇政府考虑到此款是谢某争取而来,口头同意由谢某领出该笔资金,并负责用于维修B村公路。同年4月5日,谢某从镇财政领出了10万元捐款,当日即将10万元用于归还个人借款。直至2007年10月案发
