当今巨大的科技和文化进步,是不是归于知识产权制度的功劳,需要更多的实证研究。可以先从版权制度与文化进步的关系着手,深入探讨版权在知识积累和增长中的作用,版权在技术革命中如何演化,国家法律和版权演化的关系。持续的创新完全可以与大规模的模仿、抄袭行为并存,因为基于现有创造进行再创造对于创新非常关键。版权既是斗争的起点,又是斗争的终点,国家因此也就不得不深深地介入到“自然”演化中去。以信息封锁为手段的独家版权策略与初成气候的信息自由和信息共享的互联网文化严重抵牾。建议在互联网产业革命中建立一个更加宽松、多元和公平的版权制度。
The great scientific and cultural progress of today is not due to the merits of the intellectual property system, requiring more empirical research. We can start with the relationship between copyright system and cultural progress, and discuss in depth the role of copyright in the accumulation and growth of knowledge, the evolution of copyright in the technological revolution and the relationship between national law and copyright evolution. Continuous innovation can go hand in hand with large-scale imitation and plagiarism because re-creation based on existing creations is critical to innovation. Copyright is not only the starting point of the struggle, but also the end of the struggle. As a result, the state has to deeply intervene in the evolution of “nature.” The exclusive copyright strategy with the blockade of information and the Internet culture of information-sharing and information-sharing in the early stage have been seriously denied. It is proposed to establish a more liberal, pluralistic and fair copyright system in the Internet industry revolution.
