立案和立案统计作为一项侦察诉讼活动和执法活动,历来都被各级公安机关所重视。但是,立案不实屡纠不能治根,不同时期有其不同的表现形式。1995年元月至7月,宁夏全区刑事案件与上年同期相比下降14.2%,在公安部上半年通报下降的16个省区中位居第三。为了查明原因,采取针对性措施,区公安厅组织专人就刑事立案统计进行了抽样调查,发现不如实立案统计不仅普遍存在,且水分增大,有的县区达20%以上,最高可达30%以上,再结合实际存在的部分群众受害后不向公安机关报告,实际统计水分达50%。其主要表现形式有:一是忽视盗窃手段情节,自定立案统计标准自公安部修改盗窃案件立案统计办法以来,区公安厅下发文件并多次派员督促检查各地严格执行新的立案标准情况,但一直难以达到规定的“4·2·2”标准要求。一些县市(区)基本按照盗窃价值把握立案统计;还有一些县市既不考虑手段情节,也不考虑盗窃后果,而是自定立案统计标准。×市公安局自行确定:一般盗窃案件立案标准是500元以上,由派出所受理,重大盗窃案件标准是3000元以上,由刑警队受理,人为的将立案标准提高。该市一个派出所1至7月受理报警案件45起,按照立案标准应立18起,实际只立10起,未立的占44.4%。
