本文通过阐述“理念”和“法的理念”的内涵,得到经济法理念含义的概括:经济法的理念就是制定实施经济法所期望达到的社会效应或者目的,并且在这一过程中所要遵循的原则。理念并非只存在于主观世界中,所以经济法理念必然与时代息息相关,通过与民法的比较,笔者发现近代出现的经济法的意义在于它的实质正义,即保护弱者达到结果上的公正,而这也正是经济法独立存在的基础之一。
Through the connotation of “idea” and “idea of law”, this article sums up the conceptions of economic law idea: the idea of economic law is to formulate the social effect or purpose that economic law is expected to achieve and in this process In the principle to be followed. The concept is not only in the subjective world. Therefore, the concept of economic law is bound to be closely linked with the times. By comparing with the civil law, the author finds that the significance of the modern economic law lies in its substantive justice, that is, protecting the weak to achieve fair results.
