宪法学著作可谓汗牛充栋,但对于宪法存在的特殊性问题及其背后的根由,却缺乏进一步研究。《中国宪法文化研究》开创了用文化学原理阐释部门法之义的先河,构建了宪法文化研究的体系。从价值取向所形成的行为指令作用结果的视角,研析了人民主权、分权制衡、法治、人权保障四大宪法原则在中国的演变与重构,由此可归纳出中国宪法文化演化的四方面特征:理念上高度一致的社会利益、一元集中的权力安排、“德命天授”的正当性证明方式、官本化的利益救济模式,从而描绘了一幅中国宪法的俯瞰图景。
There are a lot of books on constitutional law, but there is no further study on the particularity of the constitution and the reasons behind it. The study of constitutional culture in China has created a precedent for interpreting the meaning of departmental law with the principles of cultural studies and constructed a system for studying constitutional culture. From the perspective of the result of the action directive formed by the value orientation, this paper analyzes the evolution and reconstruction of the four constitutional principles of the people’s sovereignty, the separation and separation of powers, the rule of law and the safeguard of human rights in China. From this we can conclude the four Aspect features: a highly consistent social interest in philosophy, a centralized power arrangement, a justification of “moral” and an interest-based mode of government-oriented relief, thus depicting a bird’s eye view of the Chinese constitution.
