借助一件公众热议的刑事案件并通过实证调查的方式,本文考察了宽严相济刑事政策在基层司法中的实际运行情况,认为是当前社会的司法环境与案件特点的共同挤压塑造了基层刑事司法量刑轻缓的趋势。在此基础上,本文提出应当反省简单回应政治形势的司法裁判思维,检讨现有的法院内部管理设计,建立一套行之有效的整体性制度安排,以避免法官功利或片面理解适用司法政策。
With the help of a public heated criminal case and through empirical investigation, this paper examines the actual operation of the criminal policy of Temper Justice with Mercy in grassroots justice, and considers that the coexistence of the judicial environment and the features of the case in current society shapes the basic criminal Judicial fine sentencing trend. On this basis, this paper proposes that we should reflect on the judicial review of the political situation, review the existing design of the internal management of the court and set up a set of effective institutional arrangements to avoid the utilitarian judge or unilateral understanding of applicable judicial policies.
