传销是指组织者或者经营者发展人员,通过对被发展人员以其直接或者间接发展的人员数量或者销售业绩为依据计算和给付报酬,或者要求被发展人员以交纳一定费用为条件取得加入资格等方式,组成具有一定层级性的欺诈组织,骗取财物,牟取非法利益,扰乱经济社会秩序的行为。传销是一种民事事实行为,是一种侵权行为,受民法调整。应当根据传销的组织者、骨干分子、一般参与者在传销过程中的过错程度及原因力的大小分别承担返还财产,赔偿损失等相应的民事责任。
