一、导论在英美法系国家,排除合理怀疑是法官用来指导陪审团认定案件事实、做出有罪裁判的重要司法指令。因为在英美法系国家的司法审判中,陪审团负责案件事实的裁判,被告人有罪无罪最终取决于陪审团做出的裁判。作为从社会大众中挑选出的普通人,当他们的抉择影响到被告人的人身自由之时他们该如何面对,他们该如何做出公正的决断成为一直以来困扰着陪审团的问题。而排除合理怀疑恰恰是解决陪审团裁判中所面临的难
I. Introduction In Anglo-American legal systems, excluding reasonable doubt is an important judicial directive that a judge uses to guide a jury in finding a case and making a guilty verdict.
