自从“驰名商标”这个概念进入中国以来,很多人不清楚竟一个商标达到什么标准才可能被认定为“中国驰名商标”。笔者在工作中经常有企业咨询“我的企业是本省的著名商标,可不可以认定中国驰名商标?”或“驰名商标的认定起点是多少亿?”等问题,希望笔者能给他们一个清晰、量化的标准。驰名商标与目前国内其他荣誉称号的区别在于它不是简单“申请”而来,而是在与他人纠纷过程中产生的副产品,这是《商标法》第十三条的题中应有之意,也就是说即使具备了驰名商标的条件(内因),如果没有适当的纠纷(外因),是不能被认定为驰名商标的。标认定的内因和外因作简单分析,希望能对正在困惑的安防业内人士有所帮助。针对企业最困惑的问题,结合现有法律、法规等规定和笔者的一些实践经验,在本文中就驰名商
