【裁判要旨】雇主对雇员在雇佣活动中所发生的损害结果承担无过错赔偿责任,即使该损害由雇员自身原因而引发,也不能因此而免责,但承担的份额应有所减少。
Referee motto: The employer bears no-fault liability for the result of the employee’s injury in the employment activity. Even if the damage is caused by the employee’s own reasons, the employer should not be exempt from the liability, but the share of the employer should be reduced.
