量刑公正是刑法追求公正价值的主要体现。目前,在司法实践中,由于法律对犯罪规定了相对确定的法定刑,容易造成法官滥用刑法裁量权的情形发生。因此,如何监督法官的刑法裁量权,实现量刑公正,成为我国刑事司法面临的一个重要课题。在这种背景下,1999年我国一些基层检察院开始了对量刑建议制度的试用,2005年7月,最高人民检察院出台了《人民检察院量刑建议试点工作实施意见》,正式将量刑建议列为检察改革项目,但目前对量刑建议的改革还处于摸索阶段,各地基层检察院在具体行使量刑建议权时采取不同的做法。为此,本文就检察机关统一和具有可操作性地行使量刑建议权的问题予以阐释,以供商榷。
Sentencing justice is the main embodiment of the pursuit of fair value in criminal law. At present, in judicial practice, due to the law provides for a relatively fixed statutory sentence of crime, it is easy for judges to abuse the criminal law discretion. Therefore, how to supervise the judge’s discretion of criminal law and realize the sentencing justice has become an important issue facing our country’s criminal justice. Under this background, some grass-roots procuratorates in China began the trial of the sentencing recommendation system in 1999. In July 2005, the Supreme People’s Procuratorate promulgated Opinions on the Implementation of Pilot Sentencing Proposals by the People’s Procuratorate, formally listing sentencing recommendations as procuratorial reform However, at present, the reform of the sentencing recommendations is still at a groping stage. Various local grass-roots procuratorates take different approaches when they specifically exercise their sentencing suggestions. Therefore, this article explains the problem that the procuratorial organs have the unified and operative power to exercise sentencing suggestion.
