2013年8月30日,十二届全国人民代表大会常务委员会第四次会议通过了《关于修改〈中华人民共和国商标法〉的决定》。这标志着历经十年的第三次商标法修改工作已经圆满完成。从公开的修法资料来看(主要基于国家工商总局、国务院法制办、全国人大法工委公开征求意见稿),具体条款的修改过程既充满了理论观点的碰撞与交锋,也掺杂着各方利益的博弈与妥协,笔者认为有必要将若干重点问题的主要观点与形成结果作一梳
