科技成果转化法以促进科技进步及成果转化为立法目的,但却在科技成果转化主体的功能定位上存在明显立法偏差,难以发挥法律对科技成果转化主体的立法保障作用。分析科技成果转化立法与实践的差异,调整立法偏差,将会有助于促进科技成果转化法的有效实施。
However, there are obvious legislative deviations in the functional orientation of the main body of the transformation of scientific and technological achievements so that it is difficult to exert the legislative guarantee function of law on the main body of the transformation of scientific and technological achievements. Analyzing the differences between legislation and practice in transforming scientific and technological achievements and adjusting the legislative deviations will help promote the effective implementation of the law on scientific and technological achievements.
