油气资源的共同开发是国际实践发展的产物,其作为一种兼具政治与法律色彩的临时性安排,在海洋划界争端的处理和跨界资源的利用等方面发挥着重要作用。国际合作与和平解决国际争端等国际法基本原则、《联合国海洋法公约》的相关规定以及双边划界协议中的专门性规定,构成了海洋资源共同开发的国际法基础。国际社会共同开发的实践各具特点,针对南中国海这片争议海域,环南中国海国家应充分发挥共同开发机制的积极作用,结合南中国海的特殊情况,因地制宜地建立共同开发油气资源的争端解决机制,并充分注意到“第三国”的权利问题,在加强对争议海域油气资源开发利用的同时,以期缓解乃至消除环南中国海国家间的海洋划界争端。维护国际海域的和平、安全与良好秩序。
The joint development of oil and gas resources is a product of the development of international practice.
