知识产权在当今社会发展中越来越受到重视,但是知识产权面临着被不适当的运用的风险———滥用。在欧美的发达国家,防止知识产权滥用是一个重要的法律理论与实践问题,但在我国仍是一个新出现的问题。随着改革的不断深入,经济高速发展,对知识产权滥用的规制刻不容缓。日前工商总局拟推细则界定知识产权滥用、排除限制竞争,笔者认为应该在明确反垄断法律规定的同时,让知识产权回归市场,加强市场推动。
Intellectual property is gaining more and more attention in the development of today’s society, but intellectual property is facing the risk of misuse - abuse. In the developed countries in Europe and the United States, preventing abuse of intellectual property is an important issue of legal theory and practice, but it is still an emerging issue in our country. With the deepening of reform and the rapid economic development, the regulation of abuse of intellectual property is urgent. Recently, the SAIC proposed to push the details of the definition of abuse of intellectual property rights, excluding restrictions on competition, the author believes that the law should be clear anti-monopoly, at the same time, let the return of intellectual property market and strengthen market promotion.
