从20世纪80年代开始在俄罗斯推行的社会经济改革促进了市民社会的成长,为《俄罗斯联邦民法典》确认自然理性和权利思想奠定了较为坚实的社会基础。《俄罗斯联邦民法典》确立的民法基本原则以及关于具体民事法律制度的规定凸现了俄罗斯联邦民法的私法精神。在制定中国民法典的今天,有必要对《俄罗斯联邦民法典》作更为全面、科学和切合历史的理解,把关注的视角投向《俄罗斯联邦民法典》生成的历史轨迹,真正揭示出最能体现其基本精神和本质特征之所在,从而为中国民法典的制定提供科学的思路与深邃的启迪。
The socio-economic reforms promoted in Russia since the 1980s promoted the growth of civil society and laid a solid social foundation for the confirmation of natural rationality and rights in the Civil Code of the Russian Federation. The basic principles of civil law established by the Civil Code of the Russian Federation and the provisions on specific civil legal systems highlight the private law spirit of the civil law of the Russian Federation. In the process of formulating the Chinese Civil Code, it is necessary to make a more comprehensive, scientific and historical understanding of the civil code of the Russian Federation, and to turn the focus of attention on the historical trajectory generated by the Civil Code of the Russian Federation. Reflecting its basic spirit and essential characteristics, thus providing scientific ideas and profound enlightenment for the formulation of Chinese civil code.
