高校体育场馆对外开放立法对于我省促进全民健身活动具有重要的保障意义。现行立法规定为配套立法明确了主要方向和基本原则,但也存在立法体系有待健全、立法内容相对单薄、缺乏强制保障性和实践操作性等立法不足。造成目前立法不足的主要障碍包括政府立法重视不够,职能部门推诿责任以及高校自身困难限制等因素。本文提出我国学校体育场馆对外开放立法应当建立政府保险赔偿制度、完善突发事件预警机制、规范政府经费资助制度、健全职能部门协调机制等立法对策。
The legislation of college and university sports stadiums opening to the outside world is of great significance to the promotion of national fitness activities in our province. The current legislation stipulates the main directions and basic principles for the supporting legislation, but there are also some legislative issues to be perfected, such as the relatively weak legislative content, lack of compulsory protection and practical operability. The main obstacles that cause the current lack of legislation include the inadequate attention paid by the government, the responsibility of the functional departments and the constraints of the colleges themselves. This paper puts forward that legislation of our country’s stadiums and gymnasiums opening to the outside world should set up a government insurance compensation system, improve the early warning mechanism for emergencies, standardize the government funding system and improve the coordination mechanism of functional departments.
