作为国有企业的内部监控机制,国有企业监事会的重要功能在于维护投资者利益,防止国有资产流失。然而,目前我国的国有企业无论是国有独资企业还是国有控股企业,监事会均存在监督弱化现象,缺乏对国有企业经营者进行有效监督。因此,如何从法律和制度上强化国有企业的监事会制度,无疑具有重要的理论价值与现实意义。
As the internal control mechanism of state-owned enterprises, the important function of the board of supervisors of state-owned enterprises is to safeguard the interests of investors and prevent the loss of state-owned assets. However, at present, both the state-owned enterprises in our country and the state-owned holding enterprises and supervisory boards all have the phenomenon of weakening supervision and the lack of effective supervision of the state-owned enterprise operators. Therefore, how to strengthen the supervisory board system of state-owned enterprises legally and institutionally has undoubtedly important theoretical and practical significance.
