《山东省劳动合同条例》已于2001年10月28日经山东省第九届人大常务委员会第23次会议通过,于2002年1月1日起施行。省劳动保障厅厅长李戈受省政府委托,在省九届人大常委会第22次会议上对《条例》作说明。现摘登如下:一、关于适用范围的问题《劳动法》规定,“在中华人民共和国境内的企业、个体经济组织(以下统称用人单位)和与之形成劳动关系的劳动者,适用本法。”“国家机关、事业组织、社会团体和与之建立劳动合同关系的劳动者,按照本法执行。”《条例草案》基本上沿用了《劳动法》的适用范围,并作了补充。根据1998年国务院发布的《民办非企业单位登记管理暂行条例》的规定,民办非企业单位的用人制度也应当进行规范。据此,《条例草案》规定:“在本省行政区域内的企业、民办非企业单位、个体经济组织和与之形成劳动关系的
The ”Regulations on Labor Contract of Shandong Province“ was passed at the 23rd meeting of the Standing Committee of the Ninth National People's Congress of Shandong Province on October 28, 2001 and came into force on January 1, 2002. Issues Concerning the Scope of Application The Labor Law stipulates that ”This Law applies to enterprises, individual economic organizations (hereinafter referred to as the employer) and laborers with whom they form labor relations within the territory of the People's Republic of China. “” State organs, business organizations, social organizations and workers with whom a contract of employment is established shall be governed by this Law. “” The Bill essentially follows the scope of the Labor Law and supplements it . According to the “Provisional Regulations on the Registration and Management of Private-owned Non-enterprise Units” promulgated by the State Council in 1998, the employment system of private non-enterprise units should also be regulated. Accordingly, the “Bill” stipulates: "Enterprises in the administrative areas of the province, private non-enterprise units, individual economic organizations and the formation of labor relations
