死刑作为剥夺犯罪分子生命的刑罚方法,是一种古老而又严厉的刑罚手段,然而,在我们建设社会主义和谐社会的今天,死刑由于它的残酷性、不可纠错性而受到越来越多的质疑,因此,近年来,死刑控制与死刑制度的改革,一直是我国刑法学界乃至整个社会关注的热点和焦点问题。本文将从实体控制、司法限制、限制死刑第三条道路、域外经验四个方面总结2007年我国死刑研究的成果,希望对于我国死刑制度的完善以及司法实践有所脾益。
Death Penalty, as a method of deprivation of criminals’ lives, is an ancient and severe punishment method. However, as we build a socialist harmonious society today, the death penalty has been getting more and more due to its cruelty and uncorrectability Therefore, in recent years, the reform of the death penalty control and the death penalty system has always been the focus and focus of attention of the criminal law academics in our country and the society as a whole. This article summarizes the results of the study on death penalty in China in 2007 from the aspects of entity control, judicial restriction, the third way to limit the death penalty, and extraterritorial experience. It is hoped that the death penalty system in our country will be improved and the judicial practice will be beneficial.
