诉讼费用与诉讼权利一样,与诉讼利用人的利益紧密相关。法院收费制度的合理性,在一定程度上反映着一个国家的人民享受法律保障的程度。~①关于劳动争议案件的诉讼收费,1989年的《人民法院诉讼收费办法》第5条第7款规定:“劳动争议案件,每件交纳30~50元。”2007年的《诉讼费用交纳办法》(以下简称《交纳办法》)第13条第4款规定:“劳动争议案件每件交纳10元。”根据《交纳办法》第15条、第16条的规定,以调解方式结案或者当事人申请撤诉的案件,及适用简易程序审理的案件均减半交纳案件受理费,追索劳动报酬的案件还可以不预缴受理费。可见,劳动争议案件的诉讼受理费实行定额制,且金额设定较
