公共利益是一个历久弥新的话题,经过几百年的演变与发展,其内涵已经发生了巨大变化。本文以公共利益为切入点,与个人利益进行比较分析,说明某些情况下公共利益的不断扩张是对个人利益的侵害。希望理论界与立法者对公共利益作出明确的界定,防止公共利益被随意地进行扩张性解释,同时各行政主体也要认真对待并保护行政相对人的个人利益。 The public interest is a time-honored topic, and its connotation has undergone tremendous changes after several hundred years of evolution and development. This article takes the public interest as the starting point and carries on a comparative analysis with individual interests, which shows that in some cases the continuous expansion of public interest is an infringement on personal interests. It is hoped that the theoretical circles and legislators will make a clear definition of the public interest so as to prevent the public interest from being freely interpreted in an expansionary way. At the same time, the administrative bodies should also take seriously and protect the personal interests of the counterparts in the administration.
