一、国际经济合作是国家之间发展合作的最重要的方式之一,亦系对发展世界经济之促进。现代世界经济已成为一种互通有无的体系,唯有通过适当的法律机制,以协调各国不同经济体系之间的商品与劳务的流通,这个体系才能有效地发挥其作用。因之,在世界范围制订经济法规乃具有特别重要意义。但迄今为止,尽管在经济领域为统一国际法规作了很多努力而收效甚微,不能适应当前国际经济生活的需要。至今,国际经济关系在很大程度上仍由各国国内法管辖。在社会主义国家里,国家对外贸的垄断,是组织与管理的基本原则(仅南斯拉夫除外,将不包括在本文范围内)。这种垄断构成其国际贸易法的基础,并同基本生产资料国有化和经济社会化相适应。社会主义各国通过有关机构和采用不同方式方法,对国际经济关系加以规
First, international economic cooperation is one of the most important ways for developing cooperation among countries and also for promoting the development of a global economy. The modern world economy has become a system of mutual exchanges. Only through appropriate legal mechanisms to coordinate the circulation of goods and services among different economic systems in different countries can the system effectively play its role. Therefore, the formulation of economic laws and regulations in the world is of special significance. However, so far, despite the efforts made in the economic field to unify the international laws and regulations, they have had little effect and can not meet the needs of the current international economic life. To this day, the international economic relations are still largely governed by the domestic laws of various countries. In socialist countries, the state’s monopoly on foreign trade is the basic principle of organization and management (except for Yugoslavia alone, it will not be included in this paper). This monopoly constitutes the basis of its international trade law and is compatible with the nationalization of the means of production and economic socialization. The socialist countries have adopted relevant institutions and adopted different ways and means to regulate international economic relations
