公众参与是体现广大人民群众最广泛意见与实现社会正义的重要方式;司法独立是司法权独立于国家的立法权与行政权,独立于其他形式的干预。伴随着我国社会主义法制体系的逐步建成,公民的法律意识不断提升。加之网络信息技术的飞速发展,司法机关的司法活动受到了广泛关注。越来越多的公民开始参与司法机关的司法活动。如何正确的处理公众参与监督与司法独立之间的关系,实现司法公正合理,是建设中国特色社会主义法治社会面临的重大问题。
Public participation is an important way to embody the broadest opinions of the majority of people and realize social justice. Judicial independence is the independence of the judicial power from the legislative and executive power of the state and independent of other forms of intervention. With the gradual establishment of China’s socialist legal system, the awareness of citizens continues to rise. Coupled with the rapid development of network information technology, the judiciary’s judicial activities have received widespread attention. More and more citizens are beginning to participate in the judiciary’s judicial activities. How to correctly handle the relationship between public participation and supervision and judicial independence and realize the fairness and justice of the judiciary is a major issue facing the construction of a socialist society ruled by law with Chinese characteristics.
