集成电路布图设计是知识产权的重要客体之一,应当受到民法的严格保护。侵犯布图设计的行为表现为非法复制布图设计、非法进口、销售侵权产品等多种形式。侵犯布图设计民事责任的构成与一般侵权民事责任的构成基本相同,但应当强调过错责任原则,且其过错只能是故意。民事责任承担的方式主要有停止侵害、赔偿损失。为公共利益、科技发展的需要,法律应当明确规定反向工程、善意侵权等不属于民事侵权。
Layout design of integrated circuit is one of the important objects of intellectual property and should be strictly protected by civil law. The act of infringing the layout design is illegally duplicating layout design, illegally importing and selling infringing products, and other forms.
