基础设施原理(essential facilities-doctrine)是指取得了市场支配地位的网络所有权人有义务保证竞争对手能够以适当的条件进入网络。这一原理在反垄断法中的适用,是促进公用企业竞争的重要手段。本文分析了这一原理产生的依据,以及在适用中可能存在的问题。并对我国反垄断立法中关于这一原理的适用进行了简要分析说明。
Essential facilities-doctrine refers to the fact that owners of networks that have gained market dominance have an obligation to ensure that competitors enter the network on the right terms. The application of this principle in antitrust law is an important measure to promote the competition of public enterprises. This paper analyzes the basis for this principle, as well as the problems that may exist in the application. And a brief analysis is given on the application of this principle in the antitrust legislation of our country.
