党的十四届三中全会通过的《中共中央关于建立社会主义市场经济体制若干问题的决定》(以下称决定)把建立社会主义市场经济体制更加具体化,规范化,给我们做好这项工作指明了方向,是我们深化改革、扩大开放、转换机制的纲领性文件。 决定指出:必须围绕着市场经济的主要环节,建立相应的法律体系。学会用法律手段管理经济。 金融市场是市场经济的主要组成部分。金融法是社会主义市场经济法律体系中的关键和枢纽,可以说,没有金融的法制化,就不会有市场经济的法制化,金融立法工作如何,关系到市场经济的成败,本文结合《决定》,就此问题谈以下学习体会,以就教于行家里手。 一、对我国金融立法工作的基本回顾 我们党和政府历来重视金融法制建设。建国来,特别是十一届三中全会以后陆续制定和颁布了不少金融法律法规,具体有这样几个方面:(一)确立中国人民银行的中央银行地位,建立以中央银行为领导、专业银行为骨干、多种金融机构并存和分工协作的金融体系,
