新型农村合作医疗的参与主体应为农村户籍居民。由于该项医保覆盖面极为广泛、情形较为复杂,为保障其能够持续、健康良性运行,国家需要立法规定“新农合”参加者的资格、权利和义务;确定“新农合”参加者的资格,应遵循普遍性原则和排他性原则。“新农合”参加者所应享有的法律权利,主要包括费用补偿权、知悉真情权、自由选择权、监督批评权、救济起诉权等;所应承担的法律义务,主要包括按时足额缴纳个人费用、如实提供个人信息材料、诚信消费、遵守管理制度等。
