改革开放以来,我国以宪法、民族区域自治法和立法法为基础的民族区域自治法规体系逐步形成,但关于民族区域自治地方自治立法的立法提案权研究仍是立法研究的薄弱环节,因此,针对民族区域自治地方立法现状的探析显得尤为重要。本文以内蒙古自治区鄂温克族自治旗为例,针对自治立法提案的现状从实践方面进行探讨,审视、评价鄂温克族自治旗立法提案的现状,并针对其不足提出建议。
Since the reform and opening up, our country has gradually formed a system of autonomous regional autonomy based on the constitution, the law of regional autonomy of ethnic minorities and the legislative law, but the study on the right of legislative proposal of legislative autonomy for ethnic minority areas remains the weak point of legislative study. Therefore, The analysis of the status quo of legislation in ethnic autonomous areas is particularly important. This paper takes the Ewenki Autonomous Banner in Inner Mongolia Autonomous Region as an example, probes into the status quo of the proposal of autonomous legislation from a practical point of view, examines and evaluates the status quo of the legislative proposal of the Ewenki Autonomous Banner, and puts forward suggestions for its inadequacies.
