法律制度需要随着科技革新和社会需求的变化而作出调整。“打车软件”的广泛使用和各地行政机构的不同做法预示着科技创新的“先发展”与法律制度的“后完善”。“专车”价格低廉迅速抢占市场,违反了公用事业领域契约之内容强制规则,损害了体制内的出租车司机在形式上平等缔约的权利;而出租车难等、挑客、拒载等违反了公用事业承运人强制缔约的义务,造成缔约双方实质不平等,不利于消费者。面对挑战,应对出租车行业的垄断体制进行改革,开放营运业市场、放宽准入条件;同时实施同等价格管制,安全和保险平等,实现竞争者与消费者缔约实质平等。
The legal system needs to be adjusted with changes in science and technology and social needs. Faced with the challenges, we should reform the monopoly system in the taxi industry, open up the market for operation and relax the access conditions. At the same time, we should implement equal price controls, equal safety and insurance, and achieve substantive equality between competitors and consumers.
