本文以德国的权威法学期刊《新法学周刊》为研究对象,希望通过对其判例的结构特征进行分析概括,对其判例制作技术进行剖析解读,为我国学界研究德国乃至大陆法系国家的判例制度提供参考样本,并从可借鉴性角度为实现依法治国前提下我国案例指导制度的构建,尤其是学界当下热议的指导性案例中裁判要点的定位和发展提供比较法上的参考和借鉴。
