1994年4月18日上午,上海市中级人民法院曾开庭审理了当时全国政协常委、中央工艺美术学院教授吴冠中状告上海朵云轩、香港永成古玩拍卖有限公司侵犯其姓名权、名誉权的案子。诉讼缘于1993年10月27日由上海朵云轩与香港永成古玩拍卖有限公司在香港联合举行的一场拍卖会上,一幅署名吴冠中、题为《毛泽东炮打司令部》的国画,以52.8万港元成交。该作品为毛泽东右手端握毛笔独自站立的半身像,画面右上角有仿“毛体”字三行—“炮打司令部/我的一张大字报/毛泽东”。熟悉“文革”历史的人知道,
On the morning of April 18, 1994, the Shanghai Intermediate People’s Court of Justice held a hearing in which Wu Guanzhong, a member of the Standing Committee of the CPPCC National Committee and a professor of the Central Academy of Arts and Crafts, sued Shanghai Duoyunxuan and Hong Kong Yong Cheng Antique Auction Co., Ltd. for infringing its name and fame case. The lawsuit was due to a painting signed by Wu Guanzhong entitled “Mao Zedong Artillery Command” on October 27, 1993, at a joint auction in Hong Kong held by Shanghai Duoyunxuan and Hong Kong Yong Cheng Antiques Auction Co., Ltd., With 528,000 Hong Kong dollar transactions. The work is a bust of Mao Zedong’s hand holding a writing brush standing alone.
