合理使用主要起源于适度限制著作人的私权,以保障公众言论发表、取得信息的自由,以达成调和社会公共利益的任务。大多数的学者都认为,任何商业性使用的目的都是不正当的,因为商业性使用将取代著作权许可使用、法定许可使用等情形,最终将损害著作权人的财产利益。但本文认为这种观点是不全面的,本文从著作权的演变,得出商业性使用并不是判断著作权合理使用标准的决定性因素。
The rational use mainly originated from the moderation of the private rights of the authors, in order to guarantee the freedom of the public to express their opinions and obtain the information, so as to achieve the task of reconciling the public interest in society. Most scholars believe that the purpose of any commercial use is illegitimate, because commercial use will replace the use of copyright licenses, statutory licensing and other circumstances, will eventually undermine the copyright owner’s property interests. However, this paper argues that this view is not comprehensive. From the evolution of copyright, this article concludes that commercial use is not the decisive factor in judging the fair use of copyright.
