小小鸟调解委员会作为司法行政机关授予民间非政府组织以人民调解员的资格,并对其进行监督和管理,这种新型的合作主义巧妙的结合了民间组织的热情和行政机关的权威,在调解打工群体劳资纠纷的实践中,效果远比仲裁或其他的司法解决途径更加的理性和高效。原因在于小小鸟在调解过程中对社会规则的熟练运用,对法律规则的拒斥。在面对社会结构断裂,纠纷类型多变化,群体纠纷日益增多的境况下,将游离于政府、法律和诉讼等正式机制之外的NGO融合到我们的纠纷解决机制之内,对于现代法治所追求的“大调解”机制具有现实的力量。
